1. MONEYTAP: là MyCash FinTech Pte. Ltd.
2. Đối tác của MONEYTAP: là các ngân hàng và công ty tài chính liên kết với MONEYTAP để cung cấp sản phẩm dịch vụ.

2. MONEYTAP’s partners: means banks and financial companies who cooperate with MONEYTAP to provide services

3. Khách hàng: là chủ thể sử dụng dịch vụ của MONEYTAP trên cơ sở đáp ứng được các điều kiện theo quy định của MONEYTAP từng thời kỳ.

3. Customers: mean the subjects who use MONEYTAP’s services on the basis of satisfying defined conditions by MONEYTAP from time to time.

4. Ứng dụng điện tử: là các ứng dụng mà MONEYTAP thiết lập và/hoặc triển khai sử dụng để giao tiếp với Khách hàng mà thông qua đó MONEYTAP cung ứng các sản phẩm, dịch vụ của MONEYTAP cho Khách hàng.

4. Electronic applications or App: mean the applications which are set and/or launched by MONEYTAP to contact its Customers. By these applications, MONEYTAP can provide its products and services for its Customers

Phương tiện điện tử: là các thiết bị hoạt động dựa trên công nghệ điện, điện tử, kỹ thuật số, từ tính, truyền dẫn không dây, quang học, điện tử hoặc công nghệ tương tự mà bằng việc sử dụng phương tiện này, Khách hàng có thể kết nối đến ứng dụng điện tử của MONEYTAP để sử dụng dịch vụ. Phương tiện điện tử có thể bao gồm (nhưng không giới hạn) máy tính để bàn, máy tính xách tay, máy tính bảng, điện thoại di động, …

5. Electronic devices: mean the devices which are operated on electrical, electronic, digital, magnetic, wireless, optical, electronic or similar technologies. By using these devices, the Customers can connect to MONEYTAP’s electronic applications to use services. Electronic devices can include (but not limited to) desktop computers, laptops, tablets, mobile phones, etc

6. Dịch vụ: là các sản phẩm, dịch vụ mà MONEYTAP cung cấp.Bao gồm việc cung cấp nền tảng công nghệ mà thông qua đó Khách hàng tiếp cận và sử dụng các sản phẩm/dịch vụ tài chính từcác Đối tác của MONEYTAP.

6. Services: mean the products, services as provided by MONEYTAP. MoneyTap provides the technology platform for customers to access the financial products and services of MONEYTAP’s partners. In other words, MONEYTAP is the technology platform provider and MONEYTAP’s partners is the lender of financial products and services

II. PHẠM VI THU THẬP THÔNG TIN

Khi sử dụng dịch vụ của MONEYTAP, Khách hàng cho phép MONEYTAP được thu thập các loại thông tin của Khách hàng như sau:

II. SCOPE OF INFORMATION GATHERING

When using MONEYTAP’s services, MONEYTAP is given its Customers’ permission to gather types of information as follows:

1. Thông tin Khách hàng cung cấp Thông tin có thể bao gồm (nhưng không giới hạn) họ tên, email, số điện thoại, tên đăng nhập, ảnh, số chứng minh nhân dân/căn cước công dân, ngày sinh, giới tính, địa chỉ, thu nhập, người tham chiếu của Khách hàng, thông tin tài khoản mạng xã hội của Khách hàng, …. Các thông tin này được Khách hàng cung cấp cho MONEYTAP khi:

1. Information as provided by the Customers It can include (but not limited to) full name, e-mail address, phone number, username, image, ID card number, date of birth, gender, address, income, reference person, social network account, etc. The Customers will provide such information for MONEYTAP under these circumstances:

1.1 Khách hàng đăng ký hồ sơ đề nghị cấp tín dụng và thanh toán các khoản nợ cho các Đối tác của MONEYTAP thông qua ứng dụng MONEYTAP.

1.1 Customers register loan applications and make payments to MONEYTAP’s parnters via MONEYTAP app.

1.2 Khách hàng truy cập và tạo tài khoản trên ứng dụng điện tử của MONEYTAP để sử dụng dịch vụ.

1.2 They give their accesses to and create their accounts on MONEYTAP’s electronic applications to use its services

1.3 Liên hệ với MONEYTAPhoặc đối tác của MONEYTAP qua tổng đài, ứng dụng điện tử, trang web và tài khoản mạng xã hội của MONEYTAP.

1.3 To contact MONEYTAP or MONEYTAP’s partners by its call center, electronic application, website and social network account

1.4 To complete customer satisfaction surveys as sent by MONEYTAP

2.1 Transaction information MONEYTAP will gather transaction information relating to the Customers’ use of its services, including (but not limited to) types of required service, time of use, transaction amount, credit facilities, and other related transaction information.

2.2 Thông tin của thiết bị MONEYTAP thu thập thông tin về thiết bị điện tử mà Khách hàng sử dụng để truy cập sử dụng dịch vụ trên ứng dụng điện tử, bao gồm (nhưng không giới hạn), model phần cứng, hệ điều hành và phiên bản, phần mềm, tên tập tin và phiên bản, ngôn ngữ ưu tiên, mã nhận diện thiết bị duy nhất, mã nhận diện quảng cáo, số seri và thông tin mạng di động…

2.2 Device information MONEYTAP will gather information on electronic devices which the Customers are using to access their use of services on electronic applications, including (but not limited to) hardware model, operating system and version, software, filename and version, priority language, sole identification code of device, advertising digital identifier, serial number and mobile network information, etc.

2.3 Thông tin vị trí MONEYTAP thu thập thông tin về vị trí của Khách hàng khi Khách hàng truy cập vào ứng dụng điện tử của MONEYTAP hoặc thông qua các phương tiện khác Khách hàng có cho phép xác định vị trí của Khách hàng.

2.3 Location information MONEYTAP will gather information on its Customers’ locations when they access its electronic application or they enable to define their locations by other devices.

2.4 Thông tin nhật ký Khi Khách hàng tương tác với các dịch vụ của MONEYTAP, MONEYTAP thu thập nhật ký máy chủ, có thể bao gồm các thông tin như địa chỉ IP của thiết bị, ngày giờ truy cập, tính năng của ứng dụng hoặc các trang đã xem, lỗi sử dụng và hoạt động hệ thống khác, loại trình duyệt và trang web của bên thứ ba hoặc dịch vụ Khách hàng đang sử dụng trước khi tương tác với dịch vụ của MONEYTAP.

2.4 Log information Upon our Customers’ interactions with MONEYTAP’s services, it will gather server log, including information such as IP addresses, access time, functions of applications or websites visited, use errors, types of browser and website of third party or services which the Customers are using before interacting with its services

2.5 Thông tin ứng dụng Thông tin MONEYTAP thu thập bao gồm (nhưng không giới hạn) loại thiết bị và các mục cài đặt, hệ điều hành, thông tin mạng di động, bao gồm cả tên nhà mạng và số điện thoại. MONEYTAP cũng thu thập thông tin về việc tương tác giữa các ứng dụng, trình duyệt và thiết bị của Khách hàng với các dịch vụ của MONEYTAP, bao gồm cả địa chỉ IP, báo cáo sự cố, hoạt động hệ thống và ngày, giờ cũng như URL tham chiếu của yêu cầu của Khách hàng.

2.5 Application information Information which is gathered by MONEYTAP includes (but not limited to) types of device and settings, operating system, mobile network information, including operator and phone number. MONEYTAP also gathers information on interaction between its Customers’ applications, browsers and devices and its services, including IP addresses, incident reports, systematic operations and date, time as well as URL as required by its Customers

2.6 Tin nhắn văn bản Khách hàng cho phép MONEYTAP được sử dụng tin nhắn văn bản để thực hiện các thao tác tích hợp trên ứng dụng điện tử mà MONEYTAP cung cấp. MONEYTAP sử dụng thông tin về tin nhắn của Khách hàng cho các dịch vụ hỗ trợ khách hàng và cho các mục đích an toàn, an ninh và phân tích.

2.6 Text message MONEYTAP is given its Customers’ permission to use text messages to perform integrated operations on electronic applications as provided by MONEYTAP. Information on their messages is used for customer services and for purposes of security and analysis by MONEYTAP.

4.1 Trợ giúp MONEYTAP tuân thủ các nghĩa vụ của mình theo quy định pháp luật;

4.2 Báo cáo các cơ quan nhà nước có thẩm quyền về việc tuân thủ những nghĩa vụ đó;

4.2 To make reports to competent state agencies on compliance with those obligations;

4.3 Đánh giá việc Khách hàng đã tuân thủ, đang tuân thủ và có thể tiếp tục tuân thủ tất cả các nghĩa vụ của mình theo các Hợp đồng, thỏa thuận, cam kết, điều khoản điều kiện…đã giao kết với MONEYTAP và đối tác của MONEYTAP hay không.

4.3 To evaluate whether its Customers have complied, are complying and will comply with all its obligations under the Contracts, agreements, commitments, terms and conditions ... entered into with MONEYTAPand MONEYTAP’s partners or is not.

1. Providing services and functions Information which is gathered by MONEYTAP is used for providing, personalizing, maintaining and improving its products and services. They are:

1.1 Ghi nhớ thông tin để Khách hàng không phải nhập lại trong quá trình truy cập hoặc lần tiếp theo khi Khách hàng sử dụng ứng dụng điện tử.

1.1 To save the information so that its Customers must not repeatedly enter during their accesses or subsequent accesses when they use electronic applications

1.2 Tự động cập nhật ứng dụng điện tử trên thiết bị của Khách hàng, xử lý lỗi phần mềm hoặc các sự cố hoạt động, phân tích dữ liệu, kiểm nghiệm và nghiên cứu.

1.2 To update automatically electronic applications on its Customers’ devices, repair software bugs or respond incidents, make data analysis, do testings and researches.

Hỗ trợ Khách hàng MONEYTAP sử dụng thông tin thu thập được như số điện thoại, địa chỉ email, địa chỉ tài khoản mạng xã hội của Khách hàng để tương tác trực tiếp với Khách hàng, thông báo cho Khách hàng biết về các thay đổi hoặc cải tiến sắp tới đối với dịch vụ của MONEYTAP; theo dõi và cải thiện dịch vụ hỗ trợ Khách hàng của MONEYTAP.

2. Customer Support MONEYTAP uses collected information such as phone numbers, email addresses, and social network accounts of customers to interact directly with Customers, informing Customers about changes or upcoming improvements for MONEYTAP services; monitor and improve MONEYTAP Customer support services.

3. Duy trì và phát triển dịch vụ MONEYTAP sử dụng thông tin của Khách hàng để đảm bảo duy trì hoạt động của các dịch vụ mà MONEYTAP cung cấp. Ngoài ra, MONEYTAP còn sử dụng thông tin của Khách hàng để cải tiến và nâng cao chất lượng dịch vụ của mình.

3. Service maintenance and development MONEYTAP uses Customer information to ensure the maintenance of the services provided by MONEYTAP. In addition, MONEYTAP also uses Customer information to improve and upgrade its service quality.

4. An toàn và an ninh MONEYTAP sử dụng thông tin của Khách hàng để cải thiện độ an toàn và tin cậy cho các dịch vụ của MONEYTAP. Điều này bao gồm việc phát hiện, ngăn chặn và ứng phó với những hành vi gian lận, lạm dụng, các rủi ro về bảo mật và vấn đề kỹ thuật có thể có hại cho Khách hàng và/hoặc MONEYTAP.

4. Safety and Security MONEYTAP uses Customer information to improve the safety and reliability of MONEYTAP services. This includes detecting, preventing and responding to frauds, abuse, security risks and technical issues that may be harmful to Customers and/or MONEYTAP.

5. Các thủ tục và yêu cầu pháp lý MONEYTAP sử dụng thông tin thu thập được để hỗ trợ cho quá trình điều tra, giải quyết khiếu nại, giải quyết tranh chấp phát sinh trong quá trình sử dụng dịch vụ của Khách hàng hoặc các hoạt động khác được pháp luật hiện hành cho phép.

5. Legal procedures and requirements MONEYTAP uses the information collected to assist in the process of investigating, resolving complaints and settling disputes arising in the process of Customer using services or other activities that are currently permitted by law.

Communication from MONEYTAP and MONEYTAP’s partners MONEYTAP and MONEYTAP’s partners can use the information collected to promote with Customers about products, services, promotions, researches, surveys, news, updates, events, prize contests, relevant rewarding, relevant advertisements and content about MONEYTAP services and other partners' services. The communication channels that MONEYTAP uses to communicate with Customers include:

6.1 Gửi thông báo trên ứng dụng (notification) đến tài khoản trên ứng dụng điện tử của Khách hàng.

6.1 Send notifications to Customer's account in his electronic application.

6.2 Gửi tin nhắn (SMS) hoặc gọi điện đến số điện thoại của Khách hàng theo thông tin MONEYTAP thu thập được từ Khách hàng.

6.2 Send SMS or call to Customer’s number using the information collected from the Customer by MONEYTAP.

6.3 Gửi thư điện tử đến địa chỉ thư điện tử, tài khoản mạng xã hội của Khách hàng theo thông tin MONEYTAP thu thập được.

6.3 Send emails to Customer’s email addresses, social network accounts using information collected by MONEYTAP.

6.4 Công bố thông báo hoặc thông tin liên lạc trên trang web https://www.moneytap.vn/ của MONEYTAP.

6.4 Display announcements or contact information on the website https://www.moneytap.vn/ of MONEYTAP.

1. Tất cả các ứng dụng điện tử của MONEYTAP đều được tích hợp các tính năng bảo mật để bảo vệ thông tin của Khách hàng.

2. MONEYTAP nỗ lực bảo vệ Khách hàng khỏi hành vi truy cập trái phép, thay đổi, tiết lộ hoặc phá hủy thông tinmà MONEYTAP nắm giữ, bao gồm:

2. MONEYTAP strives to protect Customer from unauthorized access, modification, disclosure or destruction of information held by MONEYTAP, including:

2.1 Cung cấp các tính năng bảo mật như duyệt web an toàn, kiểm tra bảo mật và xác minh người dùng;

2.1 Providing security features such as secure web browsing, security scans and user verification;

2.2 Xem xét các cách thức xử lý, lưu trữ và thu thập thông tin, bao gồm cả các biện pháp bảo mật vật lý, để ngăn hành vi truy cập trái phép vào các hệ thống của mình.

2.2 Considering ways of handling, storing and collecting information, including physical security measures, to prevent unauthorized access to our systems.

2.3 Allowing only employees or MONEYTAP’s partners to access Customer's personal information in order to process information related to MONEYTAP's operations. Anyone with this access must perform strict confidentiality obligations in accordance with MONEYTAP’s regulations.

3. Thông tin được cung cấp bởi Khách hàng được lưu trữ trong các cơ sở được kiểm soát truy cập với quyền truy cập hạn chế. Thông tin của khách hàng được truyền qua internet được bảo vệ thông qua việc sử dụng mã hóa, sử dụng lớp cổng bảo mật (SSL) hoặc các giao thức tương đương.

3. The information provided by the Customers is stored in access controlled facilities with restricted access. Customers Information transmitted over the internet is protected through the use of encryption, using the Secure Socket Layer (SSL) or equivalent protocols.

4. Nếu mật khẩu được sử dụng để giúp bảo vệ tài khoản Khách hàng và thông tin tài khoản, thì Khách hàng có trách nhiệm giữ bí mật mật khẩu. Khách hàng phải đảm bảo luôn đăng xuất, trước khi chia sẻ thiết bị với bên thứ ba và Khách hàng nên sử dụng dịch vụ để bảo vệ quyền truy cập vào Thiết bị của Khách hàng.

4. If a password is used to help protect Customers accounts and account information, it is the responsibility of the Customers to keep the password confidential. You have to ensure that You always log out, before sharing the device with a third party and it is advised that the Customers utilize a service to protect access to the Custsomers’ Device.

5. MONEYTAP sẽ sử dụng các tiêu chuẩn chung được chấp nhận để bảo vệ thông tin của Khách hàng gửi cho chúng tôi, cả trong quá trình truyền tải và khi nhận thông tin. Tuy nhiên, xin lưu ý rằng, không có phương thức truyền qua Internet, hay phương thức lưu trữ điện tử nào, an toàn 100%. Do đó, mặc dù MONEYTAP cố gắng sử dụng các phương tiện thương mại có thể chấp nhận được để bảo vệ thông tin Khách hàng, MONEYTAP không thể đảm bảo tính bảo mật tuyệt đối của nó và việc sử dụng Ứng dụng do Khách hàng chịu trách nhiệm và toàn quyền quyết định. MONEYTAP cũng không thể đảm bảo rằng thông tin của Khách hàng không được sử dụng sai trong trường hợp các biện pháp bảo vệ và giao thức của chúng tôi bị vi phạm bởi bên thứ ba độc hại. 5. MONEYTAP shall use generally accepted industry standards to protect the Customers information submitted to us, both during transmission and upon receipt. However, please be advised that, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, even though MONEYTAP strive to use commercially acceptable means to protect Customer information, MONEYTAP cannot guarantee its absolute security and your use of the App is at your sole risk and discretion. MONEYTAP also cannot warrant that such Customers information may not be misused in the event our safeguards and protocols are breached by a malicious third-party. Further, MONEYTAP are not liable to nor can we fully control the actions of other users with whom you may choose to share your information.

6. Việc thu thập, sử dụng và chia sẻ thông tin của Khách hàng bởi MONEYTAP phải tuân thủ Quy tắc Công nghệ thông tin 2011 (Quy trình và quy trình bảo mật hợp lý và Quy tắc dữ liệu hoặc thông tin cá nhân nhạy cảm)và các luật có liên quan khác.

6. The collection, usage, and sharing of Customers’ information by MONEYTAP shall be in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and other applicable laws.

V. CHIA SẺ THÔNG TIN
1. MONEYTAP sẽ không sử dụng thông tin của Khách hàng cho bất kỳ mục đích nào khác ngoài liên quan đến Ứng dụng. MONEYTAP sẽ không thuê, bán hoặc chia sẻ thông tin của Khách hàng và sẽ không tiết lộ bất kỳ thông tin nhận dạng cá nhân nào của Khách hàng cho các bên thứ ba, trừ khi: 1.1 Được sự cho phép của Khách hàng;

V. SHARING INFORMATION 

1. MONEYTAP will not use Customer’s information for any purpose other than in connection with the App. MONEYTAP will not rent, sell or share Customers information and will not disclose any of the Customer’s personally identifiable information to third parties, unless: 1.1 It is pursuant to obtaining the Customer’s permission;

1.2 Liên quan đến việc chia sẻ thông tin cho các đối tác của MONEYTAP, chẳng hạn như các tổ chức tài chính và ngân hàng.

1.2 It is in connection with disclosure to MONEYTAP’s partners such as financial institutions and banks.

1.3 Liên quan đến các dịch vụ được kết xuất thông qua Ứng dụng;

1.3 It is in connection with the services being rendered through the App;

1.4 It is to help investigate, prevent or take action regarding unlawful and illegal activities; suspected fraud, potential threat to the safety or security of any person, violations of MONEYTAP’s Terms& Conditions, or as defence against legal claims;

1.5 Trường hợp đặc biệt như tuân thủ các lệnh của tòa án, yêu cầu/ lệnh, thông báo từ các cơ quan pháp lý hoặc cơ quan thực thi pháp luật buộc chúng tôi phải tiết lộ như vậy; và nó tạo thành một phần của thông tin chia sẻ MONEYTAP với các nhà quảng cáo trên cơ sở tổng hợp

1.5 it is a case of special circumstances such as compliance with court orders, requests/order, notices from legal authorities or law enforcement agencies compel us to make such disclosure; and it forms part of the information MONEYTAP shares with advertisers on an aggregate basis

VI. KIỂM SOÁT QUYỀN RIÊNG TƯ 

1. Chỉnh sửa thông tin cá nhân 

1.1. Nếu và khi Khách hàng mong muốn xóa tên và các chi tiết khác khỏi hồ sơ của MONEYTAP, ngay lập tức khi nhận được yêu cầu bằng văn bản của Khách hàng, MONEYTAP sẽ phải tuân theo các điều khoản trong tài liệu này, xóa tất cả thông tin đó.

VI. PRIVACY CONTROL 

1. Personal information modification

1.1 If and when a Customer is desirous of having his/her name and other details removed from the records of MONEYTAP, immediately upon receiving the Customer’s written request to that effect MONEYTAP shall, subject to the terms hereof, remove and/delete all such information.

2. Dừng nhận thông báo trên ứng dụng điện tử MONEYTAPkhuyến khích Khách hàng duy trì bật tính năng nhận thông báo trên các ứng dụng điện tử do MONEYTAP cung cấp để không bỏ lỡ bất kỳ thông báo quan trọng nào từ MONEYTAP. 

Nếu Khách hàng không còn muốn nhận thông báo về các dịch vụ MONEYTAP, Khách hàng có thể thay đổi tùy chọn thông báo của mình bằng cách liên hệ với MONEYTAP tới địa chỉ email [email protected]. MONEYTAP có quyền đóng tài khoản Khách hàng nếu Khách hàng không nhận được một số thông tin quan trọng thể hiện qua các thông báo yêu cầu thực hiện các dịch vụ MONEYTAP thông qua Ứng dụng. Khách hàng không được từ chối nhận thông báo về số tiền đến hạn hoặc quá hạn mà Khách hàng nợ MONEYTAP và đối tác của MONEYTAP hoặc bất kỳ nỗ lực thu thập nào khác.

2. Notification disability on electronic application MONEYTAP encourages Customers to maintain the feature of receiving notifications on electronic applications provided by MONEYTAP to not miss any important notifications from MONEYTAP. 

If the Customer no longer wishes to receive notifications about MONEYTAP services, The Customer may change his/her notification preferences by contacting MONEYTAP to this email address [email protected] MONEYTAP reserves the right to close the Customer account if the Customer opts out of receiving certain crucial notices that are required to perform the MONEYTAP services through its App. The Customer may not opt-out of receiving notifications about due or past due amounts that the Customer owes MONEYTAP and MONEYTAP’s partners or any other collections efforts

VII. THAY ĐỔI CHÍNH SÁCH BẢO MẬT VÀ QUYỀN RIÊNG TƯ

MONEYTAP có quyền cập nhật hoặc sửa đổi Quy định bảo mật và quyền riêng tư này bất cứ lúc nào mà không cần thông báo trước và những thay đổi đó sẽ có hiệu lực ngay khi Quy định bảo mật và quyền riêng tư được cập nhật hoặc sửa đổi trên trang web của MONEYTAP và chúng tôi sẽ không bị ràng buộc phải thông báo cho bạn Bất kỳ sửa đổi nào trong tài liệu này. MONEYTAP reserves the right to update or modify this Privacy Policy at any time without prior notice and such changes shall be effective immediately upon posting the updated or modified Privacy Policy on the MONEYTAP website and we shall not be bound to inform you of any modifications hereof. Your access and use of the App following any such change constitutes your agreement to follow and be bound by this Privacy Policy, as updated or modified. For this reason, MONEYTAP encourages You to review this Privacy Policy each time You access and use the App. Your use of the App and any disputes arising therefrom, is subject to this Privacy Policy as well as the terms and conditions.

2. Trong phạm vi được pháp luật hiện hành cho phép, việc Khách hàng tiếp tục sử dụng các dịch vụ của MONEYTAP đồng nghĩa với việc Khách hàng đồng ý với các nội dung cập nhật của Quy định này.

2. To the extent permitted by applicable law, Customer's continued use of MONEYTAP services means that Customer agrees with the updated contents of this Policy.

VIII. QUY TRÌNH THAY ĐỔI THÔNG TIN KHÔNG CHÍNH XÁC 

Khách hàng có thể sửa hoặc cập nhật bất kỳ thông tin trực tuyến nào. Trong trường hợp mất chi tiết truy cập, Khách hàng có thể truy xuất tương tự hoặc nhận chi tiết truy cập mới bằng cách gửi e-mail đến: [email protected].

VIII. PROCEDURE FOR CORRECTING INACCURACIES IN THE INFORMATION 

The Customers may correct or update any information online. In the event of loss of access details the Customers may retrieve the same or receive new access details by sending an e-mail to: [email protected].
